Legal Terms.  

ANY PURCHASE WITH MODELMONK ACCEPTS THE FOLLOWING CONDITIONS: 

Any purchase confers the right to use ModelMonk textures photographs 
3d models animations character skins character faces
bump maps terrain maps tree maps alpha maps or any 
other object owned by and offered as part of the 
purchase ( referred herein as "datasets" ) 
for corporate or commercial productions
(a) made for the exclusive use of the licensee and/or; 
(b) to which the license retains copyright; and/or 
(c) that are intended for any form of commercial exploitation 
(i.e. film, television, commercial video, video games, 
games and the like).

The use of the "datasets" in video, games and/or 
other applications will be approved by Modelmonk. 
Datasets are royalty free and can be used to develop
commercial games and other types of commercial projects 
(providing it is not some sort of texture or "datasets" 
collection), which in turn may be publicly sold and
no royalties will be due to ModelMonk.

Where the "datasets", due to the nature of the game media 
design projects etc, is made available for public use 
(even if the "datasets" are made available to be directly 
worked with and manipulating by tools such as a map editor
or a texture editor) provided the intent is not for 
reselling the "datasets" as some sort of texture 
or "datasets" collection will be allowed. 

If the "datasets" are to be resold as some form
of texture or "datasets" collection, then a clearly 
recognizable link, or other suitable clear reference, 
to the "datasets" being made by modelmonk.com be made 
and a 1% charge for every "dataset" sold made payable to 
Qdevelopments. We DO STRONGLY OBJECT and will enforce
English (UK) law if our "datasets" are resold or repackaged 
as some form of texture or "datasets" collection without 
our permission.
 
A purchase is confined to a single user or seat.
We do not have any liability of any sort (including
liability for negligence) for the acts or omissions 
of other providers of telecommunication services or 
for faults in or failures of their networks and equipment. 
Although we take precautions, we cannot guarantee
the accuracy or completeness of the "datasets".
 
For this reason, your use of the "datasets" is at your 
own risk. Some of the "datasets" will have its own terms
and conditions. These may be displayed online or elsewhere.
If you access these "datasets"  you will need to comply 
with those terms and conditions. 

We have no liability (whether in negligence or otherwise)
for any loss not reasonably foreseeable by us when this 
contract starts, nor any loss of opportunity, goodwill,
reputation, business, revenue, profit, or savings you 
expected to make, wasted expenditure or data being lost 
or corrupted.

We may need to temporarily suspend the Modelmonk
service for operational reasons (e.g. for repairs, 
planned maintenance or upgrades), but before we do 
we will give you as much notice as we can. We promise
to restore the service as soon as possible after any
suspension. We will attempt to give you an alternative 
service under such conditions.

We cannot guarantee that the service will never
be faulty. However, we will correct all reported faults
as soon as we reasonably can. If there is a fault with
the service or you forget a password you should contact
the ModelMonk team at email@modelmonk.com

You cannot cancel the purchase under the Consumer
Protection (Distance Selling) Regulations 2000. 

The subscriber is responsible for checking the mail
sent to their email address as part of the contract.

A person who is not a party to this contract has no
right under the Contracts (Rights of Third Parties) 
Act 1999 to enforce any term of this contract but this 
does not affect any  right or remedy of a third party 
which exists or is available apart from that Act. 

English (UK) Law governs this contract and we both
agree to the exclusive jurisdiction of the English courts.
 
Neither of us can transfer this contract or any part of
it except that we can transfer all or part of it to a 
company that is a subsidiary or holding company of ours, 
or a subsidiary of that holding company (all as defined 
by Section 736 of the Companies Act 1985 as amended by
the Companies Act  1989). 

Any violations of these terms will be punishable by law
and will constitute grounds for the immediate cancellation
of further use of ModelMonk products.
 
INTELLECTUAL PROPERTY
All "datasets" are protected under European Union intellectual
property laws and remains the Intellectual Property of
ModelMonk.

Note that all "datasets" e.g texture maps, stock images were taken
by members of the Modelmonk team and all 3d models were created 
by us in 3ds unless otherwise stated. We currently use Cannon 1DS
MkII to take our stock images and from public places or places 
where we have permission to photograph.

We cannot be help responsible for the use of our datasets
by our subscribers.
